Rajan Gupta, J (Oral) This is a petition under Section 482 Cr.PC seeking quashing of FIR No.170 dated 15.5.2009 registered under Sections 419/420/120-B IPC at Police Station, Division No.4, Jalandhar on the basis of compromise.

Learned State counsel at the outset has raised an objection that entire evidence has been recorded in this case except that of one witness. The trial is nearing its culmination. Besides, there are four accused in this case. Out of four, only two have sought quashing on the basis of compromise. She submits that this petition for quashing on the basis of compromise is misconceived.

I find substance in the plea of learned State counsel. FIR was registered way back in the year 2009. Investigative machinery thereafter was set into motion and considerable court time was consumed. The trial is at its fag end and present petition has been moved on the basis of compromise by two of the accused. If such plea is accepted it may create an anomolous situation for the trial court.

I am thus of the considered view that this petition has no merit and deserves to be dismissed. Ordered accordingly. (Rajan Gupta) Judge July 06, 2015 BB
