**** Manjari Nehru Kaul, J.(Oral) Instant petition has been filed under Section 482 Cr.PC for quashing of order dated 24.11.2015 (Annexure P-2) vide which the petitioner was declared a proclaimed offender and FIR No.142 dated 08.08.20211 under Sections 323, 324, 325, 326, 148 and 149 IPC registered at Police Station City Gurdaspur, Gurdaspur as well as all the the consequential proceedings arising therefrom.

Learned counsel for the petitioner submits that FIR in question was lodged on the statement of complainant against the petitioner and other co-accused. Learned counsel further submits that since the petitioner was in Dubai, he never received any notice/summon from the Court in the FIR in question. Learned counsel still further submits that the petitioner came to know about the pendency of abovesaid FIR when he came back to India in December, 2022. It has also been submitted that the petitioner is ready to appear and join proceedings before the trial Court. Notice of motion.

CRM-M-10208-2023 -2In view of the submissions made above, the petition is disposed of with directions to the petitioner to appear and surrender before the trial Court on or before 07.03.2023 and move appropriate application for grant of bail. Till then no coercive steps be taken against the petitioner. The trial Court on such application being moved shall decide it expeditiously in accordance with law.
