The petitioner has come up before this Court under Section 482 Cr.P.C. seeking anticipatory bail in FIR No.129 dated 17.12.2024, under Sections 319(2), 318(4), 316(2), 336(2), 338, 336(3), 340(2) of Bharatiya Nyaya Sanhita (BNS), 2023 registered at Police Station Hathur, District Ludhiana Rural.

This Court, vide dated 17.02.2025, had directed the petitioner to appear before the Investigating Office on 20.02.2025 and join the investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 482(2) of BNSS, 2023. 3.

Learned State counsel, upon instructions, states that the petitioner has not joined investigation despite having been granted the last opportunity on the last date of hearing i.e. 04.03.2025, on request having been made on behalf of the petitioner for the same. He further states that the petitioner is involved in Sonia Puri 2025.03.21 14:23 I attest to the accuracy and integrity of this document

CRM-M-19613-2020 -207 more FIRs and is wanted by the police. He further informs the Court that non bailable warrants have already been issued against the petitioner in other FIR(s) pending against him.

I have heard learned counsel for both the parties. Keeping in view the fact that the petitioner did not cooperate and join the investigation despite being given opportunities, he does not deserve the concession of anticipatory bail, more particularly, when the petitioner is allegedly involved in 07 more FIRs and is a habitual offender.
