R.P. NAGRATH, J. (ORAL) This petition under Section 439 Cr.P.C. has been filed by the petitioner for grant of regular bail in FIR No. 132 dated 29.07.2014 registered under Sections 307/380/356/323/451/506/148/149 of the Indian Penal Code (IPC) at Police Station Daba, District Ludhiana. The role attributed to the petitioner is similar to the one attributed to co-accused, namely; Jasbir Singh @ Jaggi who has been granted bail by this Court vide order dated 25.11.2014 passed in CRMM-38578-2014. It is further contended that the petitioner was not named in the FIR.

CRM-M-1289-2015 -2about 25 persons who attacked the complainant party. The petitioner is in custody since 11.10.2014. For the reasons stated in the order dated 25.11.2014 passed in CRM-M-38578-2014 and without expressing any opinion on the merits of case, the instant petition is allowed and petitioner-Sandeep Singh @ Top be admitted to bail on furnishing bail bonds to the satisfaction of trial Court.

Learned counsel for the complainant submits that there is apprehension of threat to the life and liberty of the complainant and the witnesses.

It is, however, made clear that as and when the complainant and witnesses have to appear before the trial Court for evidence, the complainant may move an application to the Commissioner of Police, Ludhaina in this regard and on doing so, the Commissioner of Police Ludhiana, if warranted, shall take appropriate steps for providing necessary protection to the life and liberty of the complainant and witnesses.
