*** AMOL RATTAN SINGH , J. (ORAL) Learned counsel for the petitioner submits that the petitioner is a serving Regimental Havaldar in the Assam Rifles and has been falsely implicated due to an altercation that he had with the police party. He further points to the fact that in Form M-29, which is a part of the report submitted under Section 173 Cr.P.C., cuttings are seen in the date as also in the offence in respect of which the petitioner has been arraigned as an accused. It is further seen, as per the custody certificate filed in the Court by the learned State counsel, that the petitioner has already put in 7 months and 17 days of actual custody, with the trial not having commenced as yet.

Keeping in view the aforesaid circumstances, but without making any final comment upon the actual merits of the case, which would obviously be gone into by the learned trial Court, I consider it appropriate to admit the petitioner to bail, upon his furnishing adequate bail bonds and surety bonds to the satisfaction of that Court.
