(Oral) The allegations against Paramjit Kaur in this anticipatory bail application are that she along with her husband Harbhajan Singh have fraudulently enticed and cheated the complainant on the pretext of sending Narinder son of the complainant to Canada for which she has taken a sum of Rs 25 lacs. Neither she took Narinder to Canada nor returned the money. The bail application is opposed by the State counsel on the ground that custodial interrogation of the petitioner is essential to unearth the entire gamit of the nexus and it is vehemently argued on behalf of the petitioner that the petitioner is employed and in advance age and that there is no substantial evidence to connect her with the commission of offence. Criminal Misc. No. M-12896 of 2015 -2In view of the seriousness of the allegations and the fact that the investigations are at crucial stage, custodial interrogation is thus very essential. Moreover, powers under section 438 Cr.P.C. are to be sparingly used. No ground for anticipatory bail is made out. Dismissed.
