Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.71 dated 26.07.2015 under Sections 302 and 34 IPC, registered at Police Station Ghuman Police District Batala, District Gurdaspur.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the present petitioner has been declared as proclaimed offender on 03.12.2015 and he surrendered on 09.03.2017. CRM No.M-12965 of 2017 -2along with his wife Rajbir Kaur and daughter Sehajpreet Kaur was coming back to his house. They were attacked. Petitioner Sukhpreet Singh was stated to be armed with datar and specific injury has been attributed to him on the neck of the complainant, who succumbed to the injuries. In view of the above-facts and circumstances, I find that there is every possibility that if the petitioner is released on bail, he may abscond again and may tamper with the evidence. Supplementary challan has not been presented yet and the case is at preliminary stage. Otherwise, keeping in view the nature and gravity of the offence, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
