**** Manjari Nehru Kaul, J.(Oral) The petitioner is invoking the inherent jurisdiction of this Court under Section 482 Cr.PC for transfer of the case to some independent agency or to some higher and impartial officer. Learned counsel for the petitioner submits that despite the occurrence having taken place way back in the year 2014, no action had been taken to apprehend the accused named in the FIR as well as recovery of some parts of the body of the deceased. Learned counsel further submits that son of the petitioner had been murdered on account of the negligence of the police.

Notice of motion.

Mr. Chetan Sharma, AAG, Haryana, who is present in Court, accepts notice on behalf of the respondent-State. Learned State counsel on instructions has placed on record the copy of order dated 29.11.2018 of learned JMIC, Kurukshetra wherein it stands reflected that a protest petition stands filed by the petitioner and it SONIA BURA 2023.02.27 17:35 I attest to the accuracy and integrity of this document

CRM-M-10209-2023 -2had been ordered to tag the untrace report prepared by the investigating agency along with it. Learned State counsel has further drawn the attention of this Court to the order dated 09.02.2023 of JMIC, Kurukshetra, which reveals that repeated adjournments had been sought by the counsel for the complainant due to his non-availability and the case had been now fixed for preliminary evidence of the complainant for 04.03.2023 with last opportunity granted to the complainant for getting his preliminary evidence recorded.

In the aforementioned facts and circumstances, this Court is not inclined to invoke its inherent jurisdiction and issue directions as sought for by the petitioner.
