(ORAL) Present writ petition has been filed for directing the official respondents to deliver the possession of landed property detailed in the head note of petition situated at village Pakharpura, Tehsil Majitha, District Amritsar i.e. total area measuring 378 kanals 9 marla as mentioned under the application for demarcation as well as under the demarcation report prepared by the authorities dated 25.11.2022 as after the demarcation, the possession of landed property could not be taken due to certain confusion/mistake as the burjis/demarcation spots were erased so the petitioner moved an application for conducting fresh demarcation or handing over the possession as per the earlier demarcation report as the private respondents are obstructing him from getting the possession of his property. Further prayer has been made to RITTU 2024.02.27 13:34 I attest to the accuracy and integrity of this document

CWP No.4472 of 2024 -22024:PHHC:026869 grant the possession of the petitioner as per his respective land holding after conducting the fresh demarcation.

Learned counsel for the petitioner has submitted that prayer in this petition is for the demarcation of property of the petitioner. He submits that though earlier the demarcation was carried out but thereafter some miscreants demolished the Burjis and hence, the land of the petitioner is not identifiable as on date. He submits that a fresh demarcation should be carried out but the respondents authorities have not taken any action on the representation filed by the petitioner dated 15.01.2024.

Notice of motion to the official respondents at this stage. On asking of the Court, Mr. Navneet Singh, Sr. DAG, Punjab appears and accepts notice on behalf of respondents No.1 to 4State. He submits that the representation filed by the petitioner would be decided expeditiously.

In view of the above position, the present petition stands disposed of with a direction to respondent No.3 i.e. Tehsildar, Majitha, District Amritsar to look into the representation of the petitioner dated 15.01.2024 (Annexure P-4) and decide the same in accordance with law within a period of four weeks from the date of receipt of copy of the order.
