Petitioners have moved this petition under Section 482 Cr.P.C. for issuance appropriate direction to the respondent No.3 and 4 to consider the enquiry report wherein it has been surfaced that the private respondent No.5 has falsely implicated the petitioners by planting intoxicant tablets and fabricated false evidence against the petitioners by invoking the provisions of Section 22(c) read with Section 29 NDPS Act and Section 195 IPC and further to direct the respondents No.3 & 4 to file the supplementary report GAURAV SOROT 2022.03.15 18:10 I attest to the accuracy and integrity of this document
( 2 ) CRM-M-10924-2022 under Sections 173(8) Cr.P.C. in FIR No.117 dated 30.6.2020 registered under Sections 171, 182, 506 IPC at Police Station Khalra. Counsel for the petitioner submitted that legal notice-cum-representation (Annexure P-6) dated 29.10.2020 in this regard has also been moved before the concerned authorities, but no action has been taken as of now. Notice of motion to respondents No.1 to 4 at this stage. Mr. S.S. Deol, DAG, Punjab has accepted notice on behalf of the respondents No.1 to 4.
The counsel for the petitioners submitted that the police has not taken any action. He further submitted that he will be satisfied if necessary direction is given to respondent No.3 to take action on the aforesaid legal notice-cum-representation (Annexure P-6) dated 29.10.2020. State counsel submits that the concerned authority will look into the matter and take decision on the representation of the petitioners in accordance with law.
