***** Rajan Gupta, J. (Oral) Petitioner has prayed for regular bail in a case registered against him vide FIR No.1388 dated 21.10.2016 under Sections 324, 326, 307/34 IPC at Police Station City Panipat, District Panipat, Haryana, wherein petitioner figures as an accused. It has been urged before the court that some of the witnesses have turned hostile. Thus, petitioner is entitled to be enlarged on bail.
Learned State counsel has opposed the prayer. According to him, the allegations in the FIR are very serious. Co-accused namely Deepak chopped off the hand of the injured-Pardeep. The complainant tried to intervene, however, petitioner gave him a blow with a bottle on his head. Pardeep in order to save himself ran and hid in the fields. Even, thereafter, accused tried to follow him. Thereafter, Pardeep's parents were informed. His father came on the spot, picked up the chopped off hand and got admitted his son in Maharaja Aggarsen Hospital, Panipat. In my considered view, keeping in view the magnitude of the crime, the punishment it would entail would be conviction, the petitioner is not entitled to bail. The fact that some of the witnesses have turned hostile is not relevant at this stage. Dismissed.
