Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing of FIR No.13 dated 4.2.2018, registered under Sections 313, 511, 309, 420, 506 and 120-B of the Indian Penal Code, at
-2Police Station Dhariwal, District Gurdaspur, and all subsequent proceedings arising therefrom, on the basis of compromise dated 30.3.2019 (Annexure P-8) effected in between the parties. Pursuant to order dated 21.5.2019 of this Court, the parties appeared before the Chief Judicial Magistrate, Gurdaspur, on 12.9.2019 to get their statements recorded. Learned Chief Judicial Magistrate, Gurdaspur, has submitted his report vide letter No. 992 dated 12.9.2019, duly forwarded by the learned District and Sessions Judge, Gurdaspur, vide Endst. No.14266/RKT dated 12.9.2019.
According to the report, learned Chief Judicial Magistrate, Gurdaspur, is satisfied that compromise effected between the parties is genuine, without any pressure or undue influence. It was further reported that as per the statement of the Investigating Officer, no accused has been declared as Proclaimed Offender in this case. In compliance to order dated 21.5.2019, the petitioners have produced original receipt regarding deposit of costs of Rs.15,000/- in Court today. The same is taken on record. Be tagged at appropriate place. Considering the report of Chief Judicial Magistrate, Gurdaspur, dated 12.9.2019 and deposit of costs as well as the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.13 dated 4.2.2018, registered under Sections 313, 511, 309, 420, 506 and 120-B of the Indian Penal Code, at Police Station Dhariwal, District Gurdaspur, and all subsequent proceedings
