This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 62 dated 31.10.2017 under sections 306/506 IPC at Police Station Kotli Surat Malhi district Gurdaspur. Allegation against the petitioner is that he abetted the suicide of son of the complainant by harassing him. It is contended before the court that petitioner is incarcerated for the last five months. Prosecution has cited 15 witnesses, none of whom have been examined. Thus, petitioner deserves the concession of bail.

This court does not wish to express any opinion on the merits of the case. However, keeping in view the period of incarceration of the petitioner and the fact that trial may still take long time to conclude, I am of the considered view that no useful purpose would be served by detaining the petitioner in custody any longer. Accordingly, petition is allowed and petitioner is directed to be enlarged on bail to the satisfaction of Trial Ajay Kumar 2018.04.19 15:42 I attest to the accuracy and authenticity of this document
