In the High Court of Punjab and Haryana, at Chandigarh Civil Revision No. 1499 of 2019 Date of Decision: 27.07.2022 Gurmail Singh and Others ... Petitioner(s)

Versus

Harinder Singh and Others ... Respondent(s) CORAM: Hon'ble Mr. Justice Anil Kshetarpal.

Present:

Mr. Akshay Kumar Goel, Advocate for the petitioner(s).

Anil Kshetarpal, J.

1.

The learned counsel representing the petitioners admits that there are no allegations that the petitioners have been dispossessed, after granting the decree of injunction.

2.

Thus, the learned Executing Court has correctly dismissed the application under Order XXI Rule 32 CPC which requires the decree holder to prove that despite the defendant having an opportunity of obeying the decree, has willfully failed to obey it.

3.

Keeping in view the aforesaid facts, no ground to interfere is made out. Hence, the present revision petition is dismissed. (Anil Kshetarpal) Judge July 27, 2022 "DK"
