(ORAL) Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.170 dated 02.03.2017, registered under Section 379-B read with Section 34 of the Indian Penal Code at Police Station Model Town Panipat.
It is contended that other co-accused of the petitioner, namely, Devender @ Vikky @ Vicky has already been granted the concession of regular bail by this Court, vide order dated 27.11.2017 and the allegations against the petitioner are similar in nature. It is further contended that the petitioner is in custody since 01.04.2017 and there is no other criminal case pending against the petitioner. CRM-M-13900-2018 -2The above factual position is duly acknowledged by learned State counsel on instructions from ASI Rajesh Kumar. In view of the fact that there is no other case pending against the petitioner of the similar nature and the trial is likely to take a long time to be concluded and as such no useful purpose would be served by keeping the petitioner behind the bars any more. Therefore, in view of the abovesaid circumstances, without expressing any opinion on the merits of the case, the present petition is accepted. Petitioner-Sukhbir be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court.
However, the learned trial Court is directed to conclude the trial within a period of six months from the date of receipt of certified copy of this order and all the accused will fully cooperate with the proceedings before the learned trial Court.
