The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 3 to re-issue his passport.

Reply by way of affidavit dated 22.11.2023 of Satvir Singh, Deputy Superintendent of Police, Sub Division, Barnala, on behalf of respondent No. 2 is taken on record. Registry is directed to tag the same at appropriate place.

The petitioner was issued passport on 16.12.1981 and it was valid upto 15.12.1986. The validity of the said passport was extended upto 15.12.1991. The petitioner applied for re-issuance of passport on 18.10.2022. The petitioner was not issued passport on account of pending PARAMJIT KAUR SAINI 2023.11.22 16:26 I attest to the accuracy and authenticity of this order/judgment

CWP No.4293 of 2023 -2- 2023:PHHC:148381 FIRs. The petitioner was involved in two FIRs. The petitioner has been acquitted in FIR No. 38 dated 02.04.2007, under Sections 307, 427 of IPC, registered at Police Station, City Barnala, District Barnala, vide judgment dated 01.08.2011 passed by Additional Sessions Judge, Barnala. The police after completing investigation had filed cancellation report in FIR No. 22 dated 02.03.2007, under Sections 420, 465, 467, 468, 471, 120-B of IPC, registered at Police Station, City Barnal, District Barnala. Learned Chief Judicial Magistrate, Barnala, has issued notice to complainant. 4.

Learned counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391 5.

Faced with this, learned counsel for Union of India submits that application of the petitioner would be disposed of within six weeks from today, in accordance with law.
