The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.95 dated 24.11.2015 registered for the offences under Sections 304-B, 302, 315 and 34 IPC at Police Station Mullanpur Garibdass, District S.A.S. Nagar (Mohali). Notice of motion has been issued in this case. Mr. A.S. Dhaliwal, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner and learned Deputy Advocate General, Punjab appearing for the respondent-State and have gone through the record.
From the record, I find that the petitioner has been summoned under Section 319 Cr.P.C. in this case. In view of the interim order dated Harpal Singh Parmar 2017.07.28 18:22 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-13099 of 2017 [2] 27.4.2017 passed by this Court, the petitioner has already appeared before the learned trial Court and she has been released on bail. She is not required for any investigation or interrogation purposes. She is the mother-in-law of the deceased. The petitioner has only to face the trial. Since the trial of the case will take long time, no useful purpose will be served by sending the petitioner to custody.
Keeping in view the facts and circumstances of the present case; I find merit in this petition and the same is allowed. The interim order dated 27.4.2017 passed by this Court granting interim bail to the petitioner is made absolute.
