**** AJAY TEWARI, J.(Oral) On 11.7.2017, the following order was passed:- "Since counsel for the appellants was elevated as a Judge of this Court, through order of this Court dated 16.01.2017, the appellants were directed to be informed about the next date of hearing.

As per the office report, appellant No.2 has been served through his son but in spite of service, no-one appears on his behalf. Appellant No.1 remains unserved for want of complete address.

Another attempt be made to serve appellant No.1 by issuing fresh notice.

Adjourned to 18.01.2018."

Today, it has been reported that appellant No. 1 has died and as regards appellant No.2 he has been served but none has entered appearance on his behalf.

In the circumstances, the appeal stands dismissed for nonprosecution. Since the main case has been decided, the pending C.M, if any, also stand disposed of.
