Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.298 dated 30.11.2016 under Sections 379 and 411 IPC, registered at Police Station Pillu Khera, District Jind.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case has been registered on the basis of statement of complainant Parveen, who stated that his dumper has been stolen by some unknown thief which was parked near Vineet Gulati 2017.05.02 16:18 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-13103 of 2017 -2Badiyli pond at night. The present petitioner is nominated by the coaccused. It is argued by learned State counsel that the dumper has been recovered from the house/cattle-shed owned by the petitioner. Keeping in view the above facts and circumstances of the case, I find that the petitioner is required for investigation and interrogation purposes and no ground is made out to grant anticipatory bail to him. Therefore, finding no merit in the present petition, the same is dismissed.
