(ORAL) Present writ petition has been filed for quashing the impugned order dated 12.10.2021 (Annexure P-4) passed by respondent No.2 whereby the appeal filed by the petitioner has been dismissed and the impugned order dated 28.01.2020 (Annexure P-3) passed by respondent No.3 whereby application for conferment of proprietary right of agricultural land under the provision of Haryana Dholidar, Buttimar, Bhondedar or Mukraridar (Vesting of Proprietary Rights) Act, 2010 has been dismissed and directions were issued to the Deputy Commissionercum-District Collector Charkhi Dadri for presenting the compliance report before the Court of Commissioner, Rohtak Division, Camp at RITTU 2024.03.12 10:40 I attest to the accuracy and integrity of this document
CWP-5222-2022 (O&M) -2- 2024:PHHC:033871 Charkhi Dadri on the basis of which the Official respondents are threatening the petitioner of eviction from the land in question. Further prayer has been made for directing the respondents to forebear them from interfering with the possession of the petitioner on the land in dispute. Learned counsel for the petitioner prays for withdrawal of the present petition with liberty to the petitioner to pursue his remedy before the learned Financial Commissioner by way of filing the revision petition in accordance with law.
Allowed to do so.
In view of the above, the present petition is dismissed as withdrawn with liberty aforesaid. If any such revision petition is filed by the petitioner, the learned Financial Commissioner would decide the same in accordance with law after hearing both the sides within a period of two months from the date of filing of the revision by the petitioner.
