(Oral) This is the 5th petition filed under Section 439 Cr.PC for grant of regular bail to the petitioner in case FIR No.484 dated 14.09.2019 under Sections 148, 149, 323, 325, 307, 302, 506, 201, 212 and 120-B IPC and Section 25 of Arms Act registered at Police Station Sadar Tauru District Nuh.

At the outset, when a query was put to the learned counsel for the petitioner as to what was the material change in the circumstances and how the present petition is maintainable in view of the fact that earlier petition was dismissed on merit as recently as on 28.11.2023, he failed to satisfy this Court qua any material change in the circumstances. After arguing for sometime, when this Court was not inclined to accept the submissions made on behalf of the petitioner, learned counsel for the petitioner prays for withdrawal of the instant petition Dismissed as withdrawn.
