**** ANITA CHAUDHRY, J The petitioner has assailed the order dated 16.3.2018 (Annexure P-1) passed by the Judicial Magistrate Ist Class vide which warrants have been ordered to be issued against the witnesses summoned at the instance of respondent No. 1.
Counsel for the petitioner urges that a petition under Section 125 Cr.P.C. has been filed by the daughter-in-law of the petitioner and it is settled that the maintenance can be claimed only from the husband but respondent No. 1 has summoned the record from the office of EMAAR/MGF, Gurgaon regarding the pay package of the father-in-law and his other details which is not relevant. It was urged that an application had been filed by them that respondent No. 1 could not summon any record of the father-in-law and the Court is seeking the presence of the witnesses without taking a decision on their application.
