The present petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus, directing the official respondents for protecting life, liberty and property of the petitioners and also for taking action against respondents No.4 to 8 for giving severe beatings and extending threat to kill them.

Learned counsel appearing for the petitioners inter alia contends that the private respondents are living in their neighbourhood and they have misused the identity proof of petitioner No.2 and prepared forged and fabricated documents and used the same to take illegal possession of flat owned by Greater Ludhiana Area Development Authority (GLADA). In this regard, petitioners have filed representations dated 10.02.2024 (Annexure P-1) and 16.02.2024 (Annexure P-2). Thereafter, petitioners were attacked by private respondents and they are extending threats to them.

Having heard learned counsel for the petitioners and after perusing the record of the case, this Court finds no ground for issuance of directions as sought by the petitioners in the facts and circumstances of the present case. CRWP No.1798 of 2024 -22024:PHHC:026834 petitioners have failed to demonstrate that any cognizable offence has been made out, which warrants interference by this Court, especially no false and fabricated document or any medico-legal report has been filed to substantiate their claim. Moreover, representation dated 16.02.2024 (Annexure P-2) has been filed directly to the Commissioner of Police, Ludhiana without following the procedure as prescribed under Sections 154 (3) Cr.P.C. and the ratio of law laid down by the Hon'ble Supreme Court in Sakiri Vasu Vs. State of U.P. and others 2008 (1) RCR (Criminal) 392 and this Court in Hansa Singh Vs. State of Punjab and others, CRM-M No.18831 of 2022 decided on 12.05.2022, 4.

Consequently, the instant petition stands dismissed with costs of Rs.10,000/- to be deposited with Poor Patients Welfare Fund, PGIMER, Chandigarh for wasting precious time of the Court within a period of three weeks from today and receipt of the same shall be furnished in the registry.
