On the instructions of ASI Janak Raj, learned State counsel has informed that the petitioner has joined the investigation. After hearing counsel for the parties and going through the police file, it is apparent that the complainant has got an old rivalry with the petitioner's family. Without going into the details of the controversy, it is sufficient to observe that the injuries attributed to the petitioner with an iron rod on the right ear and left leg of Gurmail Singh, are simple in nature. It does not appear to be a case of custodial interrogation. Co-accused of the petitioner, who allegedly made an attempt to strangulate the complainant, has been arrested.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The petitioner will not commit the similar offence, of which he is accused of, during pendency of the trial. May 31 ,2016 ( M.M.S.BEDI ) TSM JUDGE
