(ORAL) Case is taken up for hearing through video conferencing. Through this petition, the petitioner seeks anticipatory bail in case bearing FIR No.553 dated 18.08.2020, registered at Police Station Shivaji Colony, Rohtak, under Section 21 of the NDPS Act (Section 29 of the NDPS Act added later on).

Vide order dated 17.03.2021, passed by a Coordinate Bench of this Court, the arrest of the petitioner was stayed. Thereafter, vide order dated 17.08.2021, the petitioner was granted ad interim anticipatory bail and had been directed to join investigation.

On 27.10.2021, learned State counsel, on the instructions from ASI Amit Kumar, has submitted that the petitioner has not joined the investigation. On 15.12.2021, again, learned learned State counsel has submitted that the petitioner has not joined the investigation. The case was adjourned and last opportunity was granted to the AMAN JAIN 2022.01.13 17:53 I attest to the accuracy of this order

Today, again, learned State counsel, on instructions from ASI Ashok, submits that the petitioner has again not joined the investigation, in compliance of the orders passed by this Court. Perusal of the record would show that despite availing the number of opportunities including the last opportunity, the petitioner has not bothered to comply with the orders passed by this Court. The petitioner cannot be allowed to avail the interim protection at the costs of violations of the conditions laid therein. Therefore, the petitioner is no longer entitled to the interim protection.
