The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of termination order (Annexure P-8) and selection list (Annexure P-7).

The petitioner pursuant to an advertisement applied for the post of Assistant Lineman. He was not selected and he filed CWP No. 6262 of 1993 before this Court. The said writ petition was disposed of with an observation that petitioner is entitled to be selected and respondent on 17.05.1994 offered appointment letter and he joined on 30.05.1994. The entire selection process came to be challenged by unsuccessful candidates. This Court vide order dated 29.11.1995 set aside the entire selection process. CWP-2373-1999(O&M) -2The respondent issued fresh advertisement on 04.03.1996. The petitioner again participated in the selection process, however, could not be selected. He came to be terminated in view of selection of another set of candidates pursuant to advertisement of 04.03.1996.

Mr,. P.K.Mutneja, Senior Advocate submits that there were 200 posts meant for Ex-servicemen, however, respondent filled 43 seats. The petitioner had secured more marks than the last selected candidate. 4.

Ms. Nikita Goel, Advocate submits that last selected candidate had secured more marks than petitioner, thus, he was not selected. 5.

I have heard learned counsel for the parties and perused the record with their able assistance.

The selection process completed in 1997 and all the selected candidates joined in the said year. The petitioner approached this Court in 1999. The matter is pending before this Court since then. A period of almost three decades from the date of completion of selection process has passed away. At this belated stage, it would not be just and fair to ask the respondent to offer an appointment letter to petitioner in the Ex-servicemen category.
