Mr.Kuldip Tiwari,Addl.AG Haryana assisted by ASI Mahesh Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail on behalf of accused petitioner-Sabir in case FIR No.654 dated 1.12.2015 under Sections 420 read with Section 34 IPC, PS Punhana, District Mewat,Haryana. As per allegations of complainant Sombir Yadav, the principal accused Afzal in connivance with the present accused Sabir cheated him for a sum of Rs.3.10 lacs on the pretext of doubling the amount by performing a pooja.

It is contended that even if the allegations are taken on the face value, no money has been handed over to the petitioner. The role attributed is only of taking complainant to the principal accused Afzal, who was stated to be a Guruji capable of doubling the amount by performing a pooja. Complainant has effected a compromise with Afzal as noticed in the order dated 28.3.2016(P-1).

CRM-M 14116/2016 Vide order dated 27.4.2016 while granting interim protection petitioner was directed to join investigation. At the time of hearing today,learned counsel for the petitioner states that in terms of the order dated 27.4.2016, petitioner has joined investigation and fully cooperated. Learned State counsel does not dispute the stand taken by the learned counsel for the petitioner and states that custodial interrogation of the petitioner is no longer required. In view of the above interim protection/bail granted vide order dated 27.4.2016 is made absolute.

Disposed of.
