The limited prayer in the present petition is for a direction to the Trial Court to decide the application under Order 39 Rule 1 and 2 CPC. 2.

Learned counsel for the petitioner would contend that the interim order dated 21.08.2023 was passed in favour of the plaintiffrespondents and now despite issues having been framed and listed for evidence, the application under Order 39 Rule 1 and 2 CPC is still pending. Learned counsel for the petitioner would further contend that he would be satisfied if a direction is given to the Trial Court to decide the application under Order 39 Rule 1 and 2 CPC.

Keeping in view the limited prayer made by learned counsel for the petitioner, the present petition is disposed off with a request to the Trial Court to decide the application under Order 39 Rule 1 and 2 CPC before proceeding further with the matter. Pending applications, if any, also stand disposed off.
