This is a Regular Second Appeal of the year 1990. Vide order dated 11.08.2016, counsel for the appellant was directed to file an application for impleading the legal representatives of respondent no.1. Till date the said order has not been complied with. Vide order dated 12.03.2020 the present appeal was directed to be shown in the urgent list since it pertains to the year 1990.

As per office report, service qua respondent nos.2 and 3 is complete. Service of respondent nos.4 to 7 was dispensed with vide order dated 08.12.2016. Qua respondent no.1, the appellant has taken no steps to implead his LRs.

On the first call, a pass-over had been sought on behalf of learned counsel for the appellant. On the second call, none has put in appearance on behalf of the appellant.

Dismissed for non-prosecution.
