The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to re-issue him passport for ten years instead of one year.

The petitioner was issued passport on 12.06.2019 which was valid upto 11.06.2029. The petitioner applied for addition of name of his spouse. The respondent found that an FIR No. 07 dated 13.01.2021, under Sections 354, 341, 506, 427, 148 and 149 of IPC and Sections 3/4 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 was registered at Police Station Sadar Zira, District Ferozepur against the petitioner. The respondent has re-issued passport dated 29.01.2024 which is valid for one year i.e. upto 28.01.2025.

Mr. D.S.Virk, Advocate, submits that original passport of the petitioner was valid for ten years, thus, validity period of the passport could not be reduced from ten years to one year.

Mr. Virk is unable to controvert the fact that order of respondent is an appealable order and the petitioner has not filed appeal before the appellate authority.
