RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 482 Cr.P.C. prayer has been made for issuance of direction to respondents No.2 to 4 to take FIR No.232 dated 11.08.2017 registered under Sections 457 and 380 IPC at Police Station City Ferozepur, District Ferozepur, against respondent No.5 to its logical end.
Learned State counsel, on instructions from ASI Naveen Kumar, Investigating Officer, submits that respondent No.5 was interrogated intensively. During interrogation, his complicity was not found in the FIR in question. Photograph (Annexure P-2) though definitely is of respondent No.2, who is a drug addict, but he did not commit crime alleged by the petitioner. Respondent No.5 on application of the police, has already been discharged.
In view of above, instant petition is dismissed as having been rendered infructuous.
