Gurmeet Singh v. State Of Punjab
-1CRM-M-8937 of 2019
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-8937 of 2019 Date of Decision: 06.05.2019 Gurmeet singh
...Petitioner
Versus
State of Punjab ....Respondent CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present:- Mr. Karan Garg, Advocate, for the petitioner. Ms. Sudeepti Sharma, Addl. A.G., Punjab.
RAMENDRA JAIN, J. (ORAL) Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.200 dated 15.09.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short the 'NDPS Act') at Police Station Sangat, District Bathinda. According to the prosecution, on 15.09.2018, petitioner was apprehended with conscious possession of 2000 tablets of Tramadol in violation of 50 of the NDPS Act without any permit or license. Learned counsel for the petitioner inter alia contends that compliance of Section 50 of the NDPS Act was not made. Petitioner is in custody since more than seven months. Conclusion of trial may take a sufficient long time inasmuch as, as on date, no witness is examined by the prosecution. No useful purpose would be served by detaining the petitioner any more in jail.

-2CRM-M-8937 of 2019 On the other hand, learned State counsel vehemently opposed bail application of the petitioner.
Heard.
Considering over all circumstances and the fact that heavy quantity of prohibited drugs, which falls under the category of "commercial quantity", has been recovered from the petitioner, he does not deserve the concession of regular bail.
Dismissed.
