NARESH KUMAR SANGHI, J (Oral) Learned counsel prays for withdrawal of the present petition to enable the petitioners to challenge the impugned summoning order by way of criminal revision petition before the Court of Session at the first instance.
Learned counsel for the respondent has no objection to the above prayer.
After hearing learned counsel for the parties, the present petition is disposed of with permission to the petitioners to file criminal revision petition against the impugned order before the Court of Session at the first instance.
In case, the petitioners move an application for condonation of delay in filing criminal revision petition within one month of passing of this order, the said application for condonation of delay shall be considered in view of the fact that the petitioners have chosen the present forum.
