In the revision petition, an application i.e. CM-9477-CII-2022 has been filed for preponement of the main case i.e. CR-650-2021 and to dispose of the same, as it has become infructuous. It is submitted by learned counsel for the applicant-respondent that revision petition was filed to challenge the assessment of the provisional rent. However, after filing of the present petition to challenge the order of assessment of provisional rent, even the eviction order has been passed vide order dated 15.04.2021, on account of non-payment of the rent, as assessed. Copy of the eviction order dated 15.04.2021 has also been placed on record as Annexure R-1.

In the light of the same, it is submitted that the present revision VINEET GULATI 2022.09.06 13:38 I attest to the accuracy and authenticity of this order/judgment Chandigarh

CR-650-2021 -2petition has become infructuous.

None has put in appearance on behalf of the tenant-petitioner today.

In view of the averments made in the application i.e. CM-9477CII-2022 , the same is allowed and the revision petition i.e. CR-650-2021, as such, is hereby dismissed, as having become infructuous.
