R.P. Nagrath, J. (Oral) Prayer in the instant petition is for grant of bail under Section 439 Cr.P.C. in FIR No. 108 dated 13.09.2014 for offences under Sections 323, 324, 341, 506, 148, 149, 325, 326 and 307 of Indian Penal Code (IPC), registered at Police Station Ramdass, District Amritsar.
Learned counsel for the petitioner states that the petitioner has since been examined by the trial Court on 22.07.2015 and his cross-examination has also been completed. The role attributed to the petitioner is that he inflicted two datar blows on the left elbow of the complainant.
Learned State counsel on instructions from ASI Kuldip Singh submits that petitioner is in custody since 28.02.2014. Similar role was attributed to Harpal Singh and Onkar Singh, who have already been granted bail.
The reply filed by learned State counsel otherwise shows that three of the accused were yet to be arrested. Trial Court would look into this aspect to see that conclusion of trial is JITENDER KUMAR 2015.07.24 10:06 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-13228 of 2015 -2not delayed due to subsequent arrest of those three accused and to consider separate trial for them in terms of Section 317 Cr.P.C. In view of the above and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
