**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the prayer made is for the release of the pensionary benefits, which have been withheld by the respondents though the petitioner retired on 31.12.2017.
As per the averments made in the writ petition, petitioner retired on 31.12.2017 but till date no retiral benefit has been released and that too without any valid justification. It has been stated that there is no impediment in the release of the pensionary benefits as there are no proceedings which are pending against the petitioner. Petitioner has served the respondents with a representation on 11.10.2018 (Annexure P-3) claiming the pensionary benefits, which is still pending consideration with the respondents. Notice of motion.

CWP-5035-2019 -2Mr. Sehaj Bir Singh, Advocate, accepts notice on behalf of the respondents-Punjab State Power Corporation Limited. Counsel for the respondents undertakes that the appropriate decision will be taken upon the representation (Annexure P-3) of the petitioner for the release of the pensionary benefits within a period of three months from today by passing an appropriate order and conveying the same to the petitioner. In case it is found after the passing of the order that the petitioner is entitled for the benefits, the same will be released to him within a further period of three months. The request of the petitioner for the grant of interest will also be considered in case it is found to be genuine.
