Mr. G.S. Bhatia, Advocate for the complainant. ARVIND SINGH SANGWAN, J. (Oral) The petitioner No.2 prays for grant of anticipatory bail in FIR No.26 dated 10.03.2018 registered under Sections 307 and 341 read with Section 34 IPC at Police Station Dayalpura, District Bathinda. Counsel for petitioner No.2 submits that petitioner No.2, in pursuance to the order dated 16.04.2018, has already appeared before the Investigating Officer and has joined the investigation. Counsel for the State, on instructions from ASI Iqbal Singh, has not disputed the factual position and submits that petitioner No.2 has joined the investigation and is no more required for any further investigation.
On the other hand, counsel for the complainant has opposed the prayer for bail on the ground that the allegations in the FIR are serious in nature.
In view of the above, the petition is allowed and the interim bail granted to petitioner No.2 vide order dated 16.04.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
