(ORAL) Counsel for the petitioner herein would submit that the petitioner had filed an application under Section 311 Cr.P.C. seeking permission to lead additional evidence, which was dismissed by the trial Court. However, during the pendency of the proceedings in the High Court, the matter has already been decided and the accused stands acquitted. He further submits that against the order of acquittal, the petitioner has already preferred an appeal wherein he has taken all pleas available to him and therefore, he seeks to withdraw the instant petition with liberty to avail any remedy available to him in accordance with law. Ordered accordingly.
