(ORAL) Through this petition, the petitioner seeks regular bail in case bearing FIR No.0217 dated 25.12.2020 registered under Sections 457/381/436/201/ 120-B IPC at Police Station Urban Estate, District Patiala. Learned counsel for the petitioner states that the petitioner has been falsely implicated in the present case. It is further stated that the petitioner has been in custody since 26.12.2020 and the co-accused Sukhwinder Singh @ Laddi has already been granted regular bail on 17.03.2021 by the co-ordinate Bench of this Court. No other case is registered/pending against the petitioner. Prosecution witnesses are yet to be examined. Moreover, there is unexplained delay of four days in lodging the present FIR as the occurrence took place during the night of 21.12.2020 and the present FIR got registered on 25.12.2020.
Learned counsel for the State while opposing the prayer of the petitioner for grant of bail, has pointed out that the petitioner was working as a SUKHPREET KAUR 2021.10.27 04:55 I attest to the accuracy and integrity of this document

servant for the last 08 years and after stealing the goods from the shop of the complainant, has shown that the fire has taken place but actually, he has committed a theft in the shop in connivance with Sukhwinder Singh @ Laddi. He further states that the challan has been presented in the present case. I have heard the learned counsel for the parties. Petitioner has been in custody since 26.12.2020. The co-accused Sukhwinder Singh @ Laddi has already been granted regular bail on 17.03.2021 by the co-ordinate Bench of this court. No any other case is registered or pending against him. Prosecution witnesses are yet to be examined. The trial is unlikely to conclude any time soon. Therefore, no useful purpose would be served by keeping the petitioner behind the bars.
In view of the above, without commenting anything on the merits, lest it should prejudice the case of either side, the present petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate.
