******* SURINDER GUPTA, J.(Oral) Both the aforementioned petitions have been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioners in case FIR No.70 dated 31.03.2016 registered for the offences punishable under Sections 21, 22, 27, 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 and 283, 482 read with Section 120-B of Indian Penal Code at Police Station Shahkot, Jalandhar. Heard.

CRM-M-14252-2018 -2Learned State counsel submits that FIR was registered on the basis of secret information on 31.03.2016. A number of persons indulging in trade and smuggling of intoxicating drugs were named in that FIR. However, no recovery from any of them was effected on the basis of secret information. He further conceded that many of the persons named in the FIR have already been allowed pre-arrest bail. Even from petitioners no recovery of any contraband was effected.

In view of the above facts but without expressing any opinion on the merits of the case, both these petitions are allowed. Petitioners are directed to surrender before the Investigating Officer and join investigation within two weeks. In the event of their arrest being required, they shall be released on anticipatory bail, subject to their furnishing bonds to the satisfaction of Arresting Officer. However, they shall abide by the terms and conditions as envisaged under Section 438(2)(i) to (iv) Cr.P.C. failing which they shall lose the benefit of interim bail allowed to them.
