IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-11940-2024 Date of Decision : 07.03.2024 Prince Kumar

...Petitioner

versus State of Punjab ....Respondent Coram :

HON'BLE MR. JUSTICE DEEPAK GUPTA Present :

Ms. Harmanpreet Kuar (Simmi), Advocate for the petitioner.

Mr. Amandeep Singh Sandhu, DAG, Punjab.

*** DEEPAK GUPTA, J. (ORAL) [1] By way of this petition filed under Section 438 Cr.P.C., petitioner is seeking anticipatory bail in case FIR No.240 dated 19.12.2020 under Section 18 of NDPS Act, 1985 (Sections 29/61 of NDPS Act added later on), registered at Police Station Anaj Mandi, Patiala, District Patiala.

[2] However, perusal of the paper book would reveal that petitioner had been declared proclaimed person vide order dated 06.08.2021 during the investigation. It is the consistent legal position that a proclaimed person is not entitled for seeking anticipatory bail. [3] Dismissed.
