The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 3 to re-issue him passport.

The petitioner was issued passport on 03.04.1997 which expired on 02.04.2007. He in January' 2002 went to Turkey and there lost his passport. He was deported back to India on 17.10.2005 and permitted to travel on Emergency Travel Certificate. He applied for re-issuance of passport on 09.11.2022. He appeared before the passport authority on 03.05.2022 but did not disclose about the Emergency Travel Certificate. He later on filed declaration disclosing all details still passport has not been issued to him.

Ms. Amrita Singh, Advocate, submits that matter is under consideration and competent authority is following the matter with Embassy at Turkey. She assures the Court that as soon as information is received from authorities at Turkey, the application of the petitioner would be processed and appropriate order shall be passed.

The passport authority cannot keep application of an applicant pending for an indefinite period on the ground of non-receipt of information from any quarter. It is responsibility of the passport authority to collect information. The passport authority is directed to process application of the petitioner within three months from today.
