State of Punjab and another .....Respondents

CORAM:

HON'BLE MR.JUSTICE RAJAN GUPTA

Present:

Mr.Mohan Singh Chaudhary, Advocate for Mr.R.S.Bains, Advocate for the petitioner.

Mr.Ankur Jain, AAG, Pb.

Rajan Gupta, J (Oral) This is a petition under Section 482 Cr.P.C seeking quashing of FIR No.12 dated 6.3.2014 under Sections 420/465/468/471 and 120-B IPC registered at Police Station, Division No.3, Ludhiana on the basis of compromise.

FIR was registered on the complaint of respondent No.2. allegation being that petitioner tried to cheat Municipal Corporation, Ludhiana by impersonating and signing on requisite documents on behalf of wife of the complainant-Asha Sood. For this purpose, signatures of Asha Sood were forged on the application. Before requisite certificate (TS-1) could be issued, matter was reported to the investigating agency. Learned State counsel, on instructions from SI-Narinder Singh, submits that matter is still under investigation. Keeping in view the facts and circumstances of the case, I am of the considered view that no case for quashing on the basis of compromise is made out as allegation is of cheating the Municipal Corporation. Proceedings need be taken to their logical end. Dismissed.
