ARVIND SINGH SANGWAN, J. (Oral) Prayer in this petition is for transfer of investigation of FIR No.106 dated 19.03.2018 registered under Sections 420, 406 and 120-B IPC at Police Station Barwala, District Hissar to State Crime Branch, Haryana.
Counsel for the petitioners has submitted that similar cases are pending against the petitioners and as per the order of the Director General of Police, Haryana, all the matters have been transferred to the Special Crime Branch, Madhuban/Gurugram. It is further submitted that the Co-ordinate Bench of this Court vide order dated 07.09.2016 passed in CRM-M No.28009 of 2016 has also directed the respondents/authorities to transfer some cases to Special Crime Branch, Madhuban/Gurugram for further action. It is also submitted that similar order has been passed by this Court in CRM-M Nos.47842 of 2017 and No.7671 of 2018 on 14.12.2017 and 23.03.2018. Counsel for the petitioners has further argued that despite the fact that the petitioners have given a representation dated 21.03.2018 to the Director General of Mohd. CRM-M No.14310 of 2018 Police (Crime), Haryana, Panchkula for transfer of the investigation of the aforesaid FIR to the State Crime Branch, no action has been taken. Notice of motion.
Mr. Himmat Singh, DAG, Haryana who is present in the Court accepts notice on behalf of the respondent. Without commenting anything on merits of the case, the present petition is disposed of with a direction to respondent No.2 to consider and decide the representation dated 21.03.2018 (Annexure P4) filed by the petitioners, in accordance with law within a period of 02 months from the date of receipt of certified copy of this order. Disposed of.
