******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 145 dated 01.11.2014 registered for the offences punishable under Sections 436, 427 read with Section 34 of Indian Penal Code at Police Station Sudhar, District Ludhiana.
Heard.
Learned State counsel on instructions from ASI Parvinder Singh submits that petitioner has joined the investigation and after its completion the challan has already been presented in the Court. The custodial interrogation of petitioner is no more required in this case and he has no objection if the order allowing interim bail is made absolute. CRM-M-13444-2017 -2expressing any opinion on the merits of the case, this petition is allowed and the order dated 21.04.2017 is made absolute subject to the condition that petitioner shall apply for regular bail (if not applied and allowed so far) before the trial Court and will keep on appearing on each and every date of hearing. In the event of his non-appearance on any date without permission, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and proceed against him in accordance with law.
