Mr. Karamjit Singh, Advocate, for the petitioner Mr. KS Pannu, DAG, Punjab along with SI Baldev Singh Fateh Deep Singh, J. (Oral) Heard. The allegations against the present petitioner Baljinder Singh in this regular bail application are that it was on the basis of the secret information the present case was got registered on 20.8.2014 in which three accused Gurlal Singh, Hira Singh and Gurpreet Singh were apprehended and 2 kgs of heroine along with 9 mm pistol and Pakistan made SIM card were recovered. It is submitted that the petitioner was arrested on 18.1.2015 and that nothing has been recovered from him and presently he is in judicial custody. The contention of the petitioner's counsel is that it is a case of no-recovery and there is no evidence to connect the petitioner with the present case, which fact is not controverted by the State counsel. Criminal Misc. No. M-13395 of 2015 -2Without adverting to the merits of the case, it is a fit case for grant of regular bail as the petitioner already undergone incarceration for a period of about four months and the trial is not likely to conclude in the near future. Accordingly, he is ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Tarn Taran.
