This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 16 dated 21.02.2015 under sections 18/25/61/85 of the NDPS Act at Police Station Mehna district Moga.
Stand of the State is that recovery of 05 Kgs of opium was effected from the petitioner and co-accused. Contraband being commercial in nature, no case for bail is made out. I find substance in the plea of the State. Quantity of contraband being commercial in nature, thus, section 37 of the Act would be attracted.
