Learned counsel for appellant No.1 states that he has not been able to implead the legal representatives of deceased appellants No.2 and 3 as he has not been able to establish contact with appellant No.1. It is to be noted that the earlier counsel had pleaded no instructions in the matter and a fresh power of attorney on behalf of appellant No.1 was filed on 30.04.2024. Thereafter, vide order dated 31.10.2025, fresh notice was issued to the parties. As per the Office report, appellant No.1 stands duly served. Appellants No.2 and 3 and the sole respondent are stated to have died. As such, there would be no requirement of issuing fresh notice to appellant No.1. 2.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
