**** ANITA CHAUDHRY, J(ORAL) The petitioner is seeking regular bail in FIR No. 53 dated 16.3.2016 registered under Sections 363, 366, 376, 328, 34 IPC at Police Station Derabassi, District SAS Nagar.
Counsel for the petitioner contends that the petitioner is in custody since 16.3.2016 and challan has been filed and the only role given to the petitioner was that she had called the girl. Counsel further urges that the prosecutrix is major and was married and she was missing from the house for over a week but the husband did not even lodge a missing report. The role given to the petitioner is that she had called the prosecutrix from her home. The allegations levelled by the victim, a married lady, were that Neelam took her to a shop where three persons were standing and she was forced into a vehicle and made to sniff intoxicant and she gained consciousness after two days and she was taken to Yamunanagar where marriage was solemnized with her and she got the opportunity to Gurpreet Singh Bhatia 2016.08.10 11:04 I attest to the accuracy and authenticity of this document High Court Chandigarh
Crl. Misc. No. M-14414 of 2016 -2escape on 14.3.2016. The police has filed the challan only against Pardeep. There is no other case pending against the petitioner. The investigation is over.
Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on her furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
