(ORAL) The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 02.02.1999 (Annexure P.1) whereby he was ordered to be reverted to his substantive rank i.e. Constable.

The petitioner preferred instant petition before this Court in 1999. Notice of motion was issued and operation of the impugned order was stayed vide order dated 25.02.1999 passed by a Division Bench of this Court. The order dated 25.02.1999 reads as:- "It is, inter alia, contended that the petitioner belongs to a separate wing of the Mounted Police since 1985 and is not a member of the general Police and, therefore, the question of his reversion in view of the guidelines, copy annexure P-3/A issued by the Director General of Police PARAMJIT KAUR SAINI 2024.11.25 05:26 I attest to the accuracy and integrity of this document

CWP No.2688 of 1999(O&M) -2would not be applicable in case of the petitioner and consequently he should not be revered.

Notice of motion for March 22, 1999.

Operation of order dated February 2, 1999, copy annexure P-1, qua the petitioner is stayed." 3.

Counsel for the parties are ad idem that petitioner on attaining the age of superannuation has retired on 30.04.2017. At that point of time, he was holding rank of Assistant Sub-Inspector meaning thereby he was granted further promotion from the post of Head Constable to Assistant SubInspector. 4.

With the efflux of time, the petition has rendered infructuous, however, Mr. Aman Dhir, DAG, Punjab submits that it may be clarified that this order may not be treated as precedent.

The petition stands disposed of. The interim order is made absolute and it is clarified that this order shall not be treated as precedent. 6.
